Haunted Peninsula Advertising Agreement & Liability Release

By submitting this registration form, I certify that I am the owner of, or have the legal authority to advertise and represent, the haunted house identified in this application.

I understand that my registration fee purchases advertising space on the Haunted Peninsula website and related promotional materials. Marsh's Free Museum, its owners, employees, volunteers, sponsors, affiliates, partners, and event organizers (collectively, the "Released Parties") are acting solely as advertisers and promoters of participating haunted houses. Listing my haunted house does not create any partnership, joint venture, agency, employment relationship, endorsement, certification, or other legal relationship between my haunted house and the Released Parties.

I acknowledge and agree that I am solely responsible for:

• The ownership, operation, and management of my haunted house.

• The safety and condition of my property, buildings, parking areas, structures, walkways, exits, props, lighting, electrical systems, special effects, actors, volunteers, employees, and attractions.

• Compliance with all applicable federal, state, and local laws, fire codes, building codes, permits, inspections, occupancy limits, accessibility requirements, insurance requirements, and any other applicable regulations.

• The collection, handling, reporting, and payment of all admission fees, taxes, merchandise sales, concessions, and any other revenue associated with my haunted house.

• Any injuries, illnesses, deaths, property damage, theft, financial losses, or other claims arising from the ownership or operation of my haunted house.

I understand that Marsh's Free Museum may advertise my haunted house on the Haunted Peninsula website, maps, social media, printed materials, and other promotional media, including my operating dates, hours, admission price, photographs, descriptions, website, and social media links.

I acknowledge that Marsh's Free Museum does not own, operate, manage, supervise, inspect, certify, endorse, guarantee, or warrant the safety, quality, legality, or operation of any advertised haunted house.

I further understand that Marsh's Free Museum does not sell tickets, collect admission fees, process payments, issue refunds, resolve customer disputes, or otherwise participate in any financial transactions between my haunted house and its customers. All financial transactions are solely between my haunted house and its patrons.

Marsh's Free Museum reserves the right, in its sole discretion and at any time, to remove or refuse any haunted house listing from its website, maps, social media, printed materials, or other promotional content. This includes, but is not limited to, situations in which Marsh's Free Museum believes a haunted house may present a safety concern, contains inappropriate content, provides misleading information, or is otherwise inconsistent with the goals of the Haunted Peninsula. Removal of a listing does not constitute an inspection, certification, approval, or determination regarding the safety or legality of the haunted house, nor does it create any duty on the part of Marsh's Free Museum to inspect, monitor, evaluate, or supervise any attraction.

To the fullest extent permitted by law, I agree to release, defend, indemnify, and hold harmless Marsh's Free Museum and the Released Parties from and against any and all claims, demands, actions, damages, liabilities, losses, judgments, costs, expenses, and attorney's fees arising out of or relating to the advertisement, promotion, ownership, operation, or visitation of my haunted house, including but not limited to claims involving personal injury, death, property damage, financial disputes, admission fees, refunds, customer complaints, code violations, negligence, or claims brought by visitors, employees, volunteers, contractors, governmental agencies, insurers, or any other third party.

I understand that I am solely responsible for obtaining and maintaining any insurance I deem necessary for the operation of my haunted house. Marsh's Free Museum does not provide insurance coverage for advertised haunted houses.

Pricing Acknowledgment

I understand that I am solely responsible for establishing, advertising, collecting, and honoring my admission price. Marsh's Free Museum is not responsible for ticket sales, payment processing, refunds, discounts, customer disputes, or any financial matters relating to my haunted house.

Photo & Promotional Media Release

I grant Marsh's Free Museum permission to photograph, video record, and use photographs, videos, logos, promotional artwork, and other media depicting my haunted house for the purpose of promoting the Haunted Peninsula. I authorize Marsh's Free Museum to reproduce, edit, publish, distribute, and display these materials on its website, social media, advertisements, printed materials, and future Haunted Peninsula promotions without compensation. I understand that Marsh's Free Museum is under no obligation to use any submitted materials and that all promotional use is at its sole discretion.

Agreement

By submitting this registration form, I acknowledge that I have carefully read, fully understand, and voluntarily agree to this Haunted Peninsula Advertising Agreement, Liability Release, Pricing Acknowledgment, and Photo & Promotional Media Release.
