Haunted House Participation Agreement & Liability Release

By submitting this registration form, I certify that I am the owner of, or have the legal authority to register and operate, the haunted house identified in this application.

I understand that participation in the Haunted Peninsula is voluntary and that Marsh's Free Museum, its owners, employees, volunteers, sponsors, affiliates, partners, and event organizers (collectively, the "Released Parties") are acting solely as promoters and coordinators of the event. Participation does not create any partnership, agency, joint venture, employment relationship, or other legal relationship between my haunted house and the Released Parties.

I acknowledge and agree that I am solely responsible for:

• The operation and management of my haunted house.

• The safety and condition of my property, buildings, structures, walkways, exits, props, lighting, electrical equipment, special effects, actors, volunteers, employees, and attractions.

• Compliance with all applicable federal, state, and local laws, fire codes, building codes, permits, inspections, occupancy limits, accessibility requirements, insurance requirements, and any other applicable regulations.

• The collection, handling, reporting, and payment of all admission fees, taxes, and other revenues associated with my haunted house.

• Any injuries, illnesses, deaths, property damage, theft, financial losses, or other claims arising from the operation of my haunted house.

I understand that Marsh's Free Museum may advertise my haunted house on its website, maps, social media, printed materials, and other promotional materials, including displaying my operating dates, hours, and admission price. I acknowledge that Marsh's Free Museum does not own, operate, manage, supervise, inspect, certify, endorse, or guarantee the safety, quality, legality, or operation of any participating haunted house.

I further understand that Marsh's Free Museum does not sell tickets, collect admission fees, process payments, handle refunds, or otherwise participate in any financial transactions between my haunted house and its visitors. All financial transactions are solely between my haunted house and its customers.

Marsh's Free Museum reserves the sole right, at any time and for any reason, to remove my haunted house from its website, maps, social media, printed materials, or any other promotional content if it determines, in its sole discretion, that continued promotion is not in the best interest of the event. This includes, but is not limited to, situations where Marsh's Free Museum believes a haunted house may present a safety concern. Removal from promotional materials does not constitute an inspection, approval, certification, or determination that a haunted house is safe or unsafe, nor does it create any duty or responsibility on the part of Marsh's Free Museum to inspect, monitor, or evaluate any haunted house.

To the fullest extent permitted by law, I agree to release, indemnify, defend, and hold harmless Marsh's Free Museum and the Released Parties from and against any and all claims, demands, actions, damages, liabilities, losses, costs, expenses, or attorney's fees arising out of or relating to my participation in the Haunted Peninsula or the operation of my haunted house, including but not limited to claims involving personal injury, death, property damage, financial disputes, admission fees, refunds, customer complaints, code violations, or claims brought by visitors, employees, volunteers, contractors, governmental agencies, insurers, or any other third party.

I further understand that I am responsible for obtaining and maintaining any insurance I deem necessary for the operation of my haunted house and that Marsh's Free Museum does not provide insurance coverage for participating haunted houses.

By submitting this form, I acknowledge that I have carefully read, fully understand, and voluntarily agree to this Haunted House Participation Agreement & Liability Release.

Pricing Acknowledgment:

I understand that I am solely responsible for establishing, collecting, and honoring my advertised admission price. Marsh's Free Museum is not responsible for ticket sales, payment processing, refunds, customer disputes, or any financial matters relating to my haunted house.

Photo & Promotional Media Release

I grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, publish, distribute, display, and promote such photographs, videos, and other media in any format or medium now known or later developed, including but not limited to websites, social media, print publications, brochures, advertisements, news releases, promotional materials, and future Haunted Peninsula marketing.

I understand that:

• I will receive no compensation or royalties for the use of these images or recordings.

• Marsh's Free Museum is under no obligation to use any photographs or recordings.

• Marsh's Free Museum may edit, crop, or modify photographs or videos for promotional purposes.

• I represent that I have obtained any permissions necessary from individuals appearing in my haunted house who may be identifiable in photographs or videos, or I accept responsibility for obtaining those permissions.

• I waive any right to inspect or approve the finished photographs, videos, or promotional materials before they are published.

I release and hold harmless Marsh's Free Museum and the Released Parties from any claims arising out of the creation, use, publication, or distribution of photographs, videos, or other media captured in connection with my participation in the Haunted Peninsula, including claims relating to privacy, publicity rights, or copyright, to the fullest extent permitted by law.
